Refund for goods: features, deadlines and step-by-step instructions

It happens that you are going to buy something. They chose for a long time, asked the price, doubted, and now, they decided. They paid money, brought the goods home ... and found a marriage! Familiar situation? Surely such a nuisance happened to everyone at least once in a lifetime. But what now to do, to present to the seller the money already paid? Someone will do so, but only if we are talking about small amounts. In the case of more or less expensive purchases, the buyer fairly expects to receive a refund for the goods or to exchange it for a new one of good quality. Fortunately, the law in this case takes the side of the buyer and provides for a number of cases in which he can easily return the product.

When the money is returned for the goods

The law provides for the option of a refund for a quality product. However, this can only be done if four conditions are met:

  • the products did not suit you in style, dimensions, configuration, size and color;
  • there is no good quality product in the store that can be replaced with a product that does not suit you;
  • the goods are not included in the list of non-exchangeable quality goods;
  • no more than fifteen days have passed from the date of purchase.

If we are talking about defective products, the buyer has the opportunity to choose the following actions:

  • refund for goods of inadequate quality;
  • replacement of goods;
  • repair at the expense of the seller;
  • repair at the buyer's expense, but with refund by the seller.

If the product was under repair for 30 consecutive days or 45 days in total, as well as if there was a repeated breakdown after the repair, the buyer is also entitled to refuse the defective products and demand a refund.

When the refund will fail

It is impossible to receive a refund for the goods in the following cases:

  • the marriage arose due to the fault of the buyer;
  • the goods are technically complex, and more than fifteen days have passed since the date of purchase;
  • the buyer did not have documents and did not find two witnesses confirming the fact of the purchase.

Return Terms

If the buyer prefers to return the spent money, he will have to leave the defective products to the seller. A refund for the product is possible throughout its warranty period. The exception is technically sophisticated tools that can be returned to the store when a marriage is discovered only in the first fifteen days from the purchase. A complete list of these products was approved in 2011 and includes:

  • aircrafts;
  • vehicles intended for movement on public roads;
  • agricultural equipment;
  • means intended for movement on snow (snowmobiles);
  • floating equipment;
  • computers, laptops, calculators, printers, televisions, digital cameras, video cameras;
  • refrigerators, water heaters, stoves, washing machines, ovens, air conditioners, dishwashers;
  • gaming consoles;
  • sets of satellite television;
  • wireless and navigation equipment.

How to get a refund for the goods: step by step instructions

It's no secret that sellers do not particularly like to return money for a marriage, but more often insist on repair or exchange. However, you must be firmly convinced: if you do not want to have any more business with this product, and want to return your money, you have the right to do so confirmed by law! What should be done so as not to waste time and, most importantly, nerves:

1. Write a statement of termination of the contract of sale / purchase, where briefly describe what goods, when you were bought, when and under what circumstances the marriage was discovered and what it consists of. Put the date and signature. The statement must be in duplicate.

2. Attach copies of the warranty card and receipt to the application (you will still need the originals).

3. If the documents confirming the fact of the purchase were not saved from you, the statement should indicate witnesses who can confirm that the defective products were indeed purchased by you. Indicate their surnames, first names, middle names, passport details and signatures.

4. Contact the salesperson of the sales area or manager and ensure that he signs on one of the applications (keep this copy for yourself), confirming that he is familiar with the application. The second copy remains with the seller.

5. The application can also be sent by valuable mail, in which case you will have a postal stamp on the second copy.

6. If the seller flatly refuses to accept the application, remind him that the right to refund money for low-quality goods is established by Federal Law No. 2300-1 โ€œOn Protection of Consumer Rightsโ€. Itโ€™s good if you have a printed version of it with you.

7. If, in this case, rejected products are not accepted, ask the sellerโ€™s representative to repeat your refusal to a voice recorder or video camera or write an official refusal. And feel free to contact the Consumer Rights Protection Department or directly to the court.
