And, of course, each of you became very angry, trying to knock on walls or batteries. Sometimes, in order to calm a stormy evening, one even has to pay a visit to those who are noisy with bad news.

Naturally, such a radical resolution of the conflict does not always lead to positive consequences - both residents consider themselves absolutely right, not even knowing how long you can listen to loud music, for example.

Night time in each city of the country is determined regionally. It is prohibited too loud at this time:

  • watch TV, listen to radio or music (including in a car, if it violates the night rest of residents of neighboring houses or other protected objects) (Clause 1, Article 8 of Law No. 273-70);
  • screaming, whistling melodies, singing, playing the button accordion or some other instrument, moving furniture and appliances, and also making noise in any other way that exceeds the permissible limits for night time (Clause 2, Article 8 N 273-70).

For these actions, the “silence law” provides for administrative liability in the form of a warning or a fine:

  • individuals - from 500 to 5,000 rubles;
  • officials - from 25 0000 to 50 000 rubles;
  • legal entities - from 50 000 to 200 0000 rubles.

How does the law work?

You may notice that the wording of this law is very vague. The exact hours of "rest" are not written for obvious reasons - Russia is a huge state, covering several time zones at once, moreover, a sunny day in a number of regions lasts longer. The best decision would be to contact the police. Most likely, they will tell you by telephone that you will need to wait for a while to see if the neighbor will calm down. In no case should you go to sort out your neighbors yourself. This can lead to physical disassembly, which means that you will also be considered an offender. Also remember - a verbal skirmish on the landing may be the basis for calling the police by other neighbors, and the outfit that comes will not understand who started it - you will all be taken to the department. Call the police yourself, if the neighbor does not calm down, you will be right in any case, because the law is on your side.

Now imagine the exact opposite situation when you broke the law. Suppose you don’t know how long you can turn on loud music, and you did it. Your neighbor is patient, as you infrequently disturb his peace. He knocks on the battery (as a warning and a demonstration of his displeasure). It would seem that if you turn off the tape recorder, then everything will be settled, but you also have the right to personal leisure.

The fact is that during the day you have the right to make noise less than 40 dB. Ordinary human conversation is about 25-30 dB. At night and during “rest hours” the noise threshold drops to 30 dB. That is, in fact, you, being in your house, can talk in an ordinary voice and listen to music equal to the volume of your voice.

Even if your neighbor hears your conversations behind the wall, and he goes to complain - this is not your problem. In this case, the builders of the house who built in advance too thin walls between the apartments are to blame.

Of course, humanly, it’s best to prevent anyone from resting at night, putting on headphones if you are a fan of listening to music at night, but no one can infringe on your rights. Simply put, making noise less than 30 dB, you do not violate the law and act in accordance with the regulations.

  • Knocking on the walls, jumping on the floor. This also applies to all children in your home. Responsibility for them lies with their parents.
  • Movement of furniture or large interior items.
  • Loading work on the landing.
  • Failure to turn off the car alarm when it is triggered.
  • The use of pyrotechnic means in the courtyard of the house.
  • Failure to stop barking, howling, or squealing your pets.
  • Any activity exceeding the noise level of 30 dB at night and 40 dB during the day.

It is worth noting that there is a week when the law on silence does not apply - this is the week of the New Year holidays. On New Year's Eve, you can afford chants, pyrotechnics, screams and loud music.
