Maternal capital is state support for Russian citizens in whom the family was replenished with a second, third or subsequent child born or adopted since 2007. Funds are paid once per family, regardless of the age of previous children (they can be adults). Starting from 2012, the amount of payments is indexed annually taking into account inflation.
Certificate
To confirm the legality of obtaining family capital in the RF PF, a certificate is issued in the form established by the state. To obtain this document, you can contact the PF after the second or next child was born (or was adopted) at any time. This document certifies that the family is eligible for state support benefits.
Terms of receipt
In order to receive state support funds, it is necessary to observe the conditions of maternity capital approved by the government:
- A woman who has given birth to a second or next child (or adopted) must be a citizen of Russia (residence does not matter).
- In the case of adoption, she cannot be a stepmother.
- The child must be a citizen of the Russian Federation.
- A man who has adopted a second or next child alone can receive family capital.
- If a woman is deprived of parental rights, then the possibility of receiving state support passes to the father or adoptive parent, citizenship does not matter.
- A man can also receive MK in the event of a woman's death.
- Family capital is distributed among children in equal parts if the father and mother (or adoptive parents) have lost their parental rights, or in connection with their death.
Certificate Documents
In order to issue a certificate, you need to provide documents to the Pension Fund department at your place of residence. What documents are needed to obtain maternity capital? The list is below:
- Correctly completed application of the established form.
- Passport or document that replaces it.
- Certificate of birth or adoption for all children.
- A document on the citizenship of the Russian Federation of a child born or adopted.
- Passport of parents with a mark of the FMS on citizenship of children.
- A document on the deprivation of the right to raise children by a wife or a certificate of her death - for a man receiving MK.
- To obtain family capital by children, documents attesting to the death of parents (or adoptive parents), as well as the deprivation of both parental rights, if any.
Having collected all the necessary documents for obtaining maternity capital and handing them over to the territorial body of the Pension Fund, you just have to wait for a decision. Under the law, fund employees themselves make copies of all documents, and the originals are returned.
Typically, the application is considered within a month. If the decision is positive, then in 5 days you will receive a notification on the issuance of the certificate. You will be notified of the refusal at the same time. The receipt must indicate the date of issue.
If you do not have the opportunity to personally submit all documents, then copies certified by a notary can be sent by mail or sent with a trustee.
Why can they refuse?
Possible reasons for which a certificate is refused:
- inaccurate information specified in the application;
- deprivation by law of the right to raise previous children;
- the child is not a citizen of Russia;
- A certificate has already been issued for your family before.
Be extremely careful when filling out the application. The information entered in the form must be truthful and accurate. Corrections are not allowed.
Consideration of all documents is carried out strictly individually. In the event of a refusal, PF employees must reasonably explain to you the reason for the refusal. How can I use MK?
Family capital cannot be spent at oneβs discretion, but only for goals approved by the state:
- improve housing conditions;
- on the funded part of the pension of the certificate holder;
- pay for children's education;
- You cannot pay for a car.
Cash is not issued directly to the hands. This avoids the use of the child as a means of receiving cash or in other financial frauds.
It is possible to use MK only after the child reaches the age of three. Since 2009, the exception is the payment of mortgage loan contributions.
Regional family capital
The proposal of the president and the government to create a regional MK was supported in many regions. What is it? In addition to federal payments, benefits are accrued in the region. The use of regional capital is the same as federal. But in some regions it can be spent on buying a car or land, to pay for the treatment of children. - certificate for MK (or its duplicate);
- application for disposal of MK funds;
- SNILS of the one for whom the certificate is issued;
- passport of the person for whom the document for obtaining the MK (or a substitute document) is issued.
In the case of construction of detached housing, it is necessary to clarify in advance what documents are needed to obtain maternity capital for the construction of a house.
