How is the characteristic drawn up in court

It is often difficult to write a characterization that is required by a lawyer or the justice authorities. When compiling it, it is necessary not only to describe the personal qualities of a person, but also his behavior in everyday life, his attitude to family values, and property status. A characteristic is drawn up in court, as a rule, in cases of bringing a person to administrative responsibility, his participation in criminal proceedings. It is an official document.

In the case when such a characteristic is required from the employer, the main value in it is information about the social and labor activities of the employee. Preferred is the option of assessing personal qualities directly by the leader, who was able to study the employee in detail and is able to most fully reproduce certain traits of his character. It is even better to first consult with the representative of the body that sent the request and find out what exactly the document should contain.

The rules for the design and compilation of business correspondence must be followed necessarily, since the characteristic to the court from the organization is attached to the materials of the legal proceedings. Hence the basic requirements for the availability of the details of the compiler. The characterization is made on the letterhead of the organization or on a standard A4 sheet with the employer's corner stamp. In an extreme case, all identification information should be contained in the seal, securing the signature of the head. Outgoing number and date of preparation of the document are desirable. A characteristic in a court may contain several structural blocks, distinguished by paragraphs. Include the name of the employee and his position in the title.

The following should be listed in the subparagraphs of the text:

- A brief questionnaire indicating the education and available specialties, if there is information about military service, they also will not hurt to reflect;

- the composition of the employee’s family, the number of persons on his maintenance;

- summarize the labor biography in your organization: when he was hired, what positions he worked for, what is his responsibility;

- evaluate his business, professional and personal qualities, if the employee was encouraged or was penalized - indicate why;

- Describe his behavior in everyday life.

When compiling the text, one should be as objective as possible, give a frank assessment of character, knowledge and skills. Characterization in court from the place of work can significantly affect the fate of your employee, so you should not be shy about expressions such as hard work and responsibility, friendliness, decency, sociability. Positive feedback from the employer is a big plus when considering a case in court.

Somewhat simpler is the household characteristic in court. Procurement for her, as a rule, is printed by proxies of a citizen involved in legal proceedings. It may not have the details or seals of any organization. The main condition for its certification is the details of the neighbors confirming it, their addresses and phone numbers (ideally, passport data or photocopies of passports).
