Changes in traffic rules: dangerous driving

Since June 2016, traffic rules have been amended mainly for those drivers who prefer “aggressive” driving. Innovations were introduced only in paragraph 2.7 of the rules, which states the prohibition of the performance by a person at the wheel of certain actions and now it has been supplemented by such a term as “dangerous driving”. The estimated fine here will be five thousand rubles. But, despite innovations in traffic rules, amendments to the Code of Administrative Offenses have not yet been made. Therefore, the responsibility for such an offense as “dangerous driving” remains in doubt until now.

Definition

What is dangerous riding and what is it expressed in? What points of the rules need to be violated by the driver in order to be punished?

Dangerous driving is expressed in the repeated performance by the driver of one or more actions occurring one after another, which are as follows:

  • failure to comply with the requirement to “give way” to vehicles with an advantage;
  • changing lanes when all lanes are busy, except when it is necessary to go around an obstacle, turn left / right or make a stop;
  • non-observance of a safe distance in front of a vehicle moving in front, as well as a side interval;
  • sudden braking, unless, of course, it was done to avoid an accident;
  • obstruction of overtaking.

Especially if this creates the danger of death or injury to people, damage to cargo, vehicles, as well as other material damage. Only in this case, such driving can be called dangerous.

It should be noted here that this definition is quite large and includes a violation of several traffic rules at once. It is for this reason that lawmakers have decided to introduce such a definition as “dangerous riding”.

How will the violation be recorded?

Of course, that not a single traffic police inspector will be able to immediately identify all traffic violators. Therefore, such special technical devices as street surveillance cameras and other devices installed in the cars of police officers will come to their aid, which will record dangerous and aggressive participants in the movement. The traffic police also hope for the awareness of other drivers who, if necessary, will be able to provide records from car registrars.

Responsibility for aggressive driving, which is a dangerous ride (SDA), the government decree does not establish - it only reinforces the new definition in the rules of the movement. In addition, the Code of Administrative Offenses of the Russian Federation also does not yet envisage any penalties for this offense. This issue is still under consideration in the State Duma. As planned, the possible fine here will vary within five thousand rubles.

Why did you need to introduce such a term as “dangerous driving” (SDA)? The government’s decree as the main document fixing this definition does not contain a concrete answer to this question. Nevertheless, lawmakers believe that with the introduction of this concept, aggressive motorists will not be so scorching on the roads and create serious obstacles to traffic.

Such an innovation as dangerous driving, traffic regulations defines the driver as repeatedly committing one or several actions consisting in the failure to provide an advantage to another vehicle, preventing overtaking, and not observing a safe distance and lateral interval when there is a real threat of death and injury to people or damage to goods, causing material damage. Nevertheless, the punishment for such behavior on the road to the Code of Administrative Offenses of the Russian Federation has not yet been fixed.

Currently, this collection of laws contains sanctions only for certain offenses, which together create the term such as “dangerous driving”. A fine for her is planned to be made within five thousand rubles. In the meantime, you can only punish a driver for aggressive driving under various articles of the current Code of Administrative Offenses. The sanctions are as follows:

  • sharp pressing the brake pedal - 1,500 rubles;
  • obstacle to overtaking - the same amount as for the first violation;
  • not give way to another transport - 500 rubles or a warning (for the first time);
  • rebuilding with strong movement, as well as non-observance of the interval and distance - 1,500 rubles for each violation.

The driver must commit several violations of clauses of traffic rules at once, so that he can be held accountable for aggressive transport management. For example, make several changes at once with heavy traffic, when all the lanes are busy, or prevent overtaking and brake sharply in front of another car. In order for such actions of the driver to be recognized as aggressive driving, they must create a danger in which the death of people, damage to other cars and goods is possible.

A term such as “dangerous driving” appeared in the traffic rules in order to stop the reckless, who, by their manner of driving, pose a serious danger to the roads for other citizens. In particular, young people on expensive foreign cars make risky maneuvers, not thinking at that moment about other motorists and pedestrians. A few rash actions, such as not observing the distance, changing lanes with heavy traffic, and braking sharply for no good reason, are directly related to such a concept as dangerous driving (SDA). An example here is the following: a citizen drove his car around the city for several hours at a speed of about 200 km / h, while he braked sharply, unexpectedly rebuilt in another row at a time when the traffic was especially intense, and also did not comply the distance. As a result, this driver drove into the rear bumper of the bus at full speed, as a result of which passengers were injured.

Special names

Each rash action of the driver, which is part of the definition of "dangerous driving", has its own national name. Here, for example, are some of them:

  • "checkers" (rebuilding with heavy traffic, when all lanes are occupied);
  • "Nervous" (aggressive motorists, creating various obstacles to other drivers);
  • "haste" (when some participants in the movement do not keep the required distance);
  • "educators" (sharp unreasonable braking in front of other vehicles);
  • "beds" - the driver does not observe the lateral interval;
  • "stubborn" - prevent the performance of overtaking.

It should also be noted here that such unreasonable actions of the participants in the movement lead to irreparable consequences. Hundreds and even thousands of people continue to die on the roads. And despite the fact that the concept of “dangerous driving” (SDA) was enshrined in the law. Article of the Code of Administrative Offenses, which would contain the type of punishment for such an offense, has not yet been provided. For this reason, it cannot be said that this innovation is valid and effective.

Although a new definition has appeared in the Traffic Rules, nothing has changed for most drivers who drive in compliance with all traffic rules.
