In connection with the increase in the cost of housing and communal services, people are increasingly asked the question: who is entitled to the subsidy for the apartment. Consider what kind of persons it relies, a list of necessary documents and the procedure for their execution. After all, the authorities do not always inform citizens properly, and for many, the regulatory framework remains somewhat unclear.
Normative regulation
LCD - a document establishing cases in which the state undertakes to help citizens in paying for housing and communal services and determines those who are entitled to a subsidy for the apartment and who are responsible for its issuance. Such a policy helps to support the population and economy of the country and prevent collapse in the payment system.
The main document regulating the provision of subsidies is government decree No. 761 of 2005. It expands the provisions of Art. 159 LCD
Therefore, to whom payments are made is decided by the rules of this document, as well as by the filing of acts adopted at the regional level.
To whom is she paid?
Firstly, payments are made on the basis of an application submitted by an interested person. Nobody does automatic charging. Secondly, everyone who is entitled to a subsidy for an apartment cannot have debts for paying utility bills. As long as there is at least a ruble of debt, help is not provided. The rule does not apply to persons who have concluded an agreement on the repayment of existing debt.
Thirdly, the charges apply only to citizens indicated in the legislative list. Who is included in this list? The list is extensive and heterogeneous. It was established that the authorities of the region cannot reduce it, changes are allowed only in favor of increasing the number of recipients, which may be:
- property owners in apartment buildings;
- Citizens who rent a house (official registration of employment is required);
- persons having a different right to reside in the premises;
- citizens registered in apartments owned by the state and municipalities;
- persons living in housing cooperatives.
Foreigners (citizens of Belarus, Kyrgyzstan, for example) are eligible for assistance subject to a permanent stay in the Russian Federation. The condition of residence is confirmed by the RVP or residence permit.
The scheme of actions when applying for subsidies for an apartment
A citizen should contact the social security and labor authorities. Information is provided at the local MFC (by the way, not all of them provide the corresponding service). Citizens who are in military service, or those whose activity is equated with that, apply to the relevant units of the ministries and departments to which they are assigned. Regional authorities have the right to transfer the authority to provide subsidies to the municipal level.
Thus, a decision on whether a subsidy is granted for an apartment is decided by three authorities. What is needed for this?
- The questionnaire is filled out in accordance with the form (presented at the office or center for the provision of municipal and state services).
- It is necessary to attach to the application the necessary package of papers in accordance with applicable law.
- The application and documents are allowed to be submitted via the Internet, using either local services or the State Services portal.
With a positive decision on the application, transfers are made to the bank account. Money can be transferred through post offices.
What documents do you need to submit
The specified list is approximate, each region has its own nuances, in addition, everything is decided at the level of which group the applicant belongs to (large family, disabled person, etc.). The list may include:
- copies of passports of family members (registered in the living area);
- foreigners entitled to help provide a passport or other document proving their citizenship of the respective state and the right to permanent residence in the Russian Federation;
- documents confirming the right of residence (certificate of ownership, lease agreement);
- certificate of family composition (issued by the passport department of the Ministry of Internal Affairs or the managing organization of the house);
- SNILS of the applicant;
- family membership is confirmed by court decisions at the initiative of the applicant;
- receipts for payment of housing and communal services for the last month;
- a copy of the work book, an extract provided at work or by the Federal Tax Service or other places on the amount of income for each family member (even the minimum stipend is taken into account);
- application with bank details of the account to which transfers are made.
The list of documents for subsidies for an apartment is significantly reduced, if you do not include those that are available to the authorities.
Who is considered a family member
The application of the norms of the family code to determine the status of each member is not correct. According to the provisions of the LCD, spouses, their children and the parents of the tenant are recognized in their quality. When concluding a social contract of employment, all residents living with the tenant are included in it.
Almost the same rules apply to privately owned housing. Family members are spouses, their children and the parents of the owner. Other relatives are reckoned to them under the condition of conducting a common household, providing mutual assistance. Even one person is enough with his small incomes to receive utility subsidies for the apartment.
The refusal of the body responsible for issuing assistance gives the right to appeal to the court for appeal or for establishing the fact of family membership, depending on what is indicated in the response.
Application Process
Having received a package of documents, the body authorized to make decisions on the payment of subsidies checks not only their completeness, but also the external compliance with the requirements of the law. It is allowed to submit requests to all institutions that issued the certificates provided by the applicant. Verification may also apply to documents proving the identity of a person. Restrictions on the subject of verification have not been established.
The rules indicate the persons in respect of whom it is allowed to conduct repeated checks, in priority are:
- tenants who do not have official work;
- citizens whose utility costs exceed twice the allowable amount of spending on housing and communal services from the total family income;
- Persons applying for assistance again.
The law established a check period of 10 days. If not all papers are submitted, then consideration of the application is suspended for 30 days, about which a notification is sent.
If after this period of time the problem is not solved, the application is returned with the attached papers and an explanation of the reason for the return. In the case of the provision of missing documents, the day of submission of all securities shall be considered the one to which the initial appeal was written.
A case is filed for each applicant, in which all documents submitted by him, answers to inquiries, and also the results of consideration of the petition are collected. The storage period of materials is at least 3 years. Information collected during the provision of subsidies is considered confidential and is held accountable for its illegal dissemination.
What pay attention
The following factors are considered when assigning payments:
- regional standards for the cost of housing and communal services;
- the share of expenses from the average monthly income of a family or a person, if he lives alone, above which assistance is paid;
- housing standards for calculating benefits.
Subsidies to apartment owners are provided taking into account the area of housing. This information is used to charge for services related to the size of the apartment or house. First of all, this is the maintenance of housing and the local area, and the provision of services where consumption metering is built on standards (there are no metering devices).
How are subsidy rates established? For example, in Moscow, a lonely person has the right to count on subsidizing 33 m 2 . Excess area is not taken into account. If there are two people living, then the standard is 42 m 2 per tenant. If the number of residents is more than 3 people, then the standard area is 18 m 2 .
A bit about the rules of calculation
Norms and standards are taken into account when entering data into the formula by which the size of payments is calculated.
Prices for services are taken into account for each settlement within the region; the seasonal difference is included in the scheme. In the case of heating, the fee can be distributed by the decision of the authority for the entire calendar year, and not accumulated during the cold season.
After receiving the payment, the consumer is obliged to submit documents on payment for services to the authorized body. Subsidies are calculated in such a way that their amount does not exceed actual expenditures for housing and communal services.
Papers are provided 10 days before the expiration of the period for which the subsidy is calculated. If actual expenses exceed the amount of the benefit, then the difference must be returned by the consumer.
Periodically there is a change in regional living wage standards. If as a result of recalculation there is a decrease in the amount of the subsidy that was previously paid, the difference remains with the consumer. If it is necessary to increase the payment, the difference is provided automatically. Neither in this nor in another situation additional documents are needed.
The specific amount of subsidies depends on the size of spending on utilities and is adjusted each time.
Payment Procedure
Those who are entitled to an apartment subsidy are assigned for 6 months. This takes into account the day on which the official application for benefits was made. If the application was submitted up to the 15th day, payment of subsidies is made from the 1st of this month. In other cases, accruals are made from the next month.
People who are entitled to a subsidy during the heating season are entitled to apply for it at any time preceding the heating season. Charges in this case are made only from the moment the heating is turned on.
Subsidies for an apartment for pensioners
Payments are made on a common basis, taking into account the costs of a person for housing and communal services.
In addition, federal and regional authorities provide additional benefits. For example, disabled people of 2 groups pay only half the cost. The benefit applies regardless of how many people live with it.
Local authorities have the right to provide additional benefits to existing categories or to establish new statuses of citizens.
The same list of documents is submitted. If the subsidy is related to the status, papers are attached that confirm it.
