Families who expect replenishment will be interested in learning about government financial support measures. In this case, it will be a question of regional family capital, namely, who has the right to receive this allowance, what it can be spent on and how its value differs in different regions of the Russian Federation.
Why is it called regional?
Very often, this type of state aid to families with children, which is issued in the constituent entities of the Russian Federation, is confused with federal support. Matkapital, the size of which as of December 2018 is 453 thousand rubles, has nothing to do with regional family capital. The lump-sum payment, which is due to the Russians who have given birth or adopted a second baby after January 1, 2007, has a fixed amount. It is mainly women who receive it, and under certain conditions, men who raise children alone.
The terms of the program of regional maternal (family) capital, the implementation of which was launched in 2011, is somewhat different from the federal state project. Common features for the two programs are the inability to withdraw (cash out) funds and their intended purpose.
The government empowered the authorities of the regions, giving them the right to allocate finances from the local budget for making one-time payments for families with children. However, regional family capital is an additional benefit. Despite the fact that its municipalities are not required to pay, the program is active in almost all the constituent entities of the Russian Federation, and in some cities, including Moscow and St. Petersburg, the authorities have developed special projects for the population.
Beneficiaries from municipalities
In most regions, the issuance of a certificate for regional family capital is carried out after the birth (adoption) of the third baby, less often the second. This assistance is one-time in nature, and it can be used by Russians who have acquired the right to receive benefits from the beginning of 2011. Sometimes the payment is called regional, provincial or governor. In addition to the federal matkapital they can count on:
- women who have given birth or have adopted three or more children (moreover, a child whose birth gives birth to the right to receive subsidies must be born after January 1, 2011);
- men who are the only legal representatives of three or more minor children, provided that at least one of them was born after the entry into force of the regional allowance order.
In accordance with the current legislation, you can issue a certificate at any time - no restrictions on the terms of circulation are indicated, however, many regions follow the federal program, setting a ban on the use of regional family capital funds until the child's three-year anniversary.
The main differences between the regional and federal payments
The fundamental difference between the local government support project for families with children and the federal one lies in the source of funding. Matkapital, which relies on families with two children, is allocated from the federal budget. The provision of regional maternal (family) capital is provided by local funds. That is why the authorities of municipalities independently establish the conditions for receiving, the exact amount of benefits and directions for targeted use.
If the capital is 453 thousand rubles. It is issued regardless of financial situation, income, status (and the indicated amount is the same for all recipients living in different parts of the country), then regional benefits in some regions of Russia are given out only to vulnerable groups of citizens (low-income, large families, families with disabled children, etc. .).
Benefits in the regions of the country
Using the example of several Russian regions, you can see how different the amounts and terms of payments can be. Let's start with Moscow. In the capital itself, the regional capital program does not work, but the city authorities provided other types of support for families that improve the demographic situation in the country. In addition to the lump-sum benefits that Muscovites accrue at the birth of their first, second, third and subsequent children, the residents of Zlatoglava are paid the so-called Luzhkov payments. Their size depends on which child was born and how old the parents are. Only young moms and dads who are not older than 30 years can apply for financial assistance.
In the Moscow region, regional family capital is issued after the birth of a second child in the period from 01/01/2011 to 12/31/2016. The amount of the subsidy is 100 thousand rubles, it is issued only once, even if after that another child is born. Regional family capital in the Moscow region can be spent on the needs associated with the purchase, construction, and repair of residential premises. Another way to apply the certificate is to pay for educational services in private or public institutions.
They give out regional family capital in St. Petersburg. In this city, the program has been extended until 2021. The amount of the allowance is 148,069.12 rubles. In St. Petersburg, only families with the status of large families, that is, having three or more children, can count on regional family capital. In addition to education for the child and housing issues, with the help of this payment the family will be able to solve other important issues - buy a car, purchase a ticket to a sanatorium or build a summer house.
Completely different conditions for issuing regional family capital in Nizhny Novgorod. Given the low demographic indicators, the authorities of the region are taking all possible measures to stimulate families to increase fertility. For children who were born between 2011 and the end of 2016 and are second in the family (third, fourth, etc.), an additional amount is paid to families with two children to the federal matkapital. The size of the one-time subsidy is 25 thousand rubles. From January 1, 2017, the terms of the program have been changed. It is interesting that in the Nizhny Novgorod region it is possible to direct funds for the repair and gasification of housing, as well as the purchase of goods and services for children with disabilities.
We give one more region as an example - Yaroslavl region. The regional family capital here is one of the smallest in the country - 56.6 thousand rubles, but, unlike most regions, this amount can be given repeatedly, that is, for every born or adopted baby after the third child. In addition, the family has the right to spend the allowance at its discretion. In Yaroslavl, regional family capital is not issued in the form of a certificate, but is transferred to the beneficiary's bank account.
How to get: how to get a certificate
To qualify for regional family capital, a citizen must meet a number of conditions that are not much different from the requirements put forward to potential recipients of federal benefits. In the vast majority of cases, there are no difficulties with the paperwork procedure. You can apply for a certificate for regional family (maternal) capital to the social protection authorities of the population or to any MFC branch. Moreover, it is not necessary to do this after childbirth - the right to make a payment is not limited to a time limit.
What documents will be required
The list of papers that parents will need to receive local financial assistance is no different from the package of documents requested for a federal payment after the second baby. The most important thing is the applicant’s passport. It is worth noting that in some regions the citizenship of the parent does not matter. The right to benefits arises in the presence of Russian citizenship in the child, therefore it is necessary to present his birth certificate, as well as the metrics of the other children in the family to establish the order of birth of the baby. If the child was adopted, then relevant documents are required to prove the right to represent his legitimate interests. The SNILS of the applicant will also be required.
Original documents are provided to the specialist for verification with copies that remain for consideration. It is allowed to provide copies of documents, since the registration of a certificate for regional family capital can last about a month. If the applicant does not have the opportunity to apply personally, he can send a package of documents by mail or through his representative with a notarized power of attorney.
The application must be written in the prescribed form (a sample document will be given directly at the reception). Filling out the application, you cannot make mistakes and provide false information. How long to wait for a decision
The issuance of a certificate for regional family capital occurs approximately 3-4 weeks after the application is submitted. During this time, data authentication is carried out, the results of which make a decision on the issue or refusal to issue. Particular attention is paid to issues related to the fulfillment by the applicant of parental duties. If a citizen is held liable for crimes against a child or is deprived of parental rights, they will not give capital. If the documents were submitted through the MFC, the period for issuing the certificate can automatically be increased by another 10 working days.
Is it possible to get my rightful money on hand
Obtaining regional family capital does not automatically give the right to dispose of money, unless the benefit is issued not in the form of a certificate, but in cash (as, for example, in Yaroslavl). In order to spend money on a particular goal, it is also necessary to follow a certain procedure.
Regional capital, like federal capital, cannot be withdrawn from a certificate to a bank card or cashed out in any other way. This restriction was introduced with one single purpose: to protect the interests of children and prevent fraud. The funds of the allowance can be directed only to the needs permitted by the local authorities. It is only possible to redirect funds by wire transfer to accounts:
- bank;
- an individual - a seller of real estate (in the case of acquisition of secondary housing);
- construction organization (when buying a home in a new building);
- medical and educational institutions.
It is also possible to transfer funds in other areas as provided by law. All other types of transactions are illegal. For an attempt to cash out the funds allocated by the state, both the owner of the certificate and the persons who initiated the illegal financial transaction may be held criminally liable.
How to improve housing conditions
So, what can you spend the money issued by the region? The most popular expense item for young families with children is the purchase of their own housing. This question is especially acute at the birth of the third or subsequent child, when the family becomes crowded in the previous apartment. This direction is the most demanded for owners of federal and regional capital, since funds can be sent not only to purchase a finished apartment for cash, but also to pay off a mortgage debt or down payment.
How to use the regional family (maternal) capital, the family decides independently, choosing one of the available methods. In the law governing the use of benefits, the direction of subsidies to resolve the housing problem implies:
- purchase of an apartment, house or cottage;
- building a house on your own or with the help of construction companies;
- reconstruction and repair of the home;
- registration of a loan to purchase an apartment in a new building or in the secondary market.
The regional allowance, like the federal one, cannot be spent until the child is three years old, but the authorities in some regions insist on compliance with this requirement. It is possible to direct regional family capital to improve housing conditions in any locality of Russia, and not necessarily where the certificate was issued.
But in practice, capital owners often face difficulties in the process of targeted use of funds. For example, not every seller of a secondary apartment is ready to wait several months until finances are credited to his account, since the decision on the use of capital is made by employees of social protection bodies for 1-2 months. Similar problems arise when buying a private home. Some citizens manage to solve the problem by obtaining a temporary loan, which they pay off with the seller of real estate, and then the capital assets are then sent to a bank account.
When building a house from scratch and repairing an existing housing, there are two options for applying state aid: either first perform the necessary work and reimburse the expenses retroactively, or transfer the money, and then proceed with the planned reconstruction and construction. Having decided to start work at your own expense, you must act carefully when completing all stages of construction, keep receipts and receipts for the purchase of materials, equipment rental, payment for services, etc.
Capital for education
Money allowances are accepted to pay for services in most institutions of preschool, school and higher education. Moreover, you can use them until the child is 25 years old. Capital funds are accepted by private and budgetary educational institutions. Thus, with the help of the regional payment it is possible to pay for studies at a university, music or art school, sports section, kindergarten, gymnasium, lyceum and other educational organizations that have the necessary license to carry out activities.
Land purchase
It is impossible to legally become the owner of land with the help of the federal mother capital, since the law does not provide for such a right. However, some regions allow owners of regional capital to acquire land at the expense of the state. The same applies to country houses: in most constituent entities of the Russian Federation it will not be possible to buy it, since the program provides for the possibility of improving housing conditions with all necessary communications, living conditions, and infrastructure.
