Each state refers to dual citizenship from its point of view. In some countries it is permitted at the legislative level, while in others it is prohibited. Russia belongs to the first category of countries. Starting from the third quarter of 2014, there is an obligation to inform the FMS of dual citizenship by a statement. A sample of such a statement, which is a notice, will be considered in this article.
Second citizenship in the Russian Federation
Upon receipt of a passport of a citizen of a foreign state, a Russian citizen acquires the citizenship of that country. At the same time, there should be no problems with double taxation, double military service and other “pleasant” trifles with countries with which a double citizenship agreement has been signed with the Russian Federation.
As of 2017, the international agreement on dual citizenship in our country was concluded only with Tajikistan and Turkmenistan.
Dual Citizenship Notice
A sample is shown in the photo. All citizens are obliged to inform the Main Department of Internal Affairs of the Ministry of Internal Affairs about dual citizenship and a residence permit in a foreign country. Neither minors nor legally incapable are exempted from this obligation.
True, the last two categories of citizens should not submit an application personally, but through a representative.
In addition to them and the previously listed persons who have received a foreign passport and have a residence permit abroad, individuals who are permanently resident abroad must notify about dual citizenship.
All of the above persons must fill out an application for dual citizenship, which is approved by order of the FMS of the Russian Federation. Documents are submitted at the place of stay or registration.
Persons who are exempted from applying for dual citizenship
Such persons include Russian citizens permanently residing in a foreign state, but upon arrival in our country they must notify the Main Department of Internal Affairs of the Ministry of Internal Affairs within 30 days.
Filling out a dual citizenship application form
The form itself, like other legal documents, can be downloaded from the Internet or obtained directly from the FMS Office. In the same places you can see a sample application for dual citizenship, which will be presented in the framework of this article.
Any citizen, except a minor and a legally incompetent person, can apply to the FMS personally, by mail or through a representative by providing a completed notice of dual citizenship. A sample fill is presented below.
The main sections to be completed are:
- state structure to which the application for dual citizenship is submitted;
- information identifying an individual with contact details;
- place of registration in the Russian Federation, regardless of whether it is permanent or temporary;
- passport data, including the series, number, by whom, when issued, date and place of birth (you should especially pay attention to the last items to persons whose actual items do not coincide with the passport);
- information on citizenship in another state;
- grounds for the adoption of citizenship of a foreign state and the date of this adoption.
The notification is filled out neatly, without errors and blots. Abbreviations and abbreviations cannot be used.
Documents submitted to the FMS
What dual citizenship documents do I need to provide?
Any applicant, as well as a representative (if any) must submit to the migration service the following package of documents:
- passport of a citizen of the Russian Federation;
- identity card of a foreigner;
- statement of residence permanently territorially in the territory of the Russian Federation.
For a minor child, a photocopy of his birth certificate must be attached. At the same time, a stamp on citizenship of the Russian Federation should be placed on it or on an insert indicating citizenship.
In addition, if the child is in care or custody, then you need to submit supporting documents. For a child under 14 years of age, a passport of any parent who is a citizen of the Russian Federation is also provided, as well as an annex to the document on registration of this child, which is issued by the authorized body of a foreign state.
Sample fill
Consider a sample dual citizenship application.
The front side of the application has two parts, one of which is filled in by the applicant or his authorized representative, and the other is tear-off by the FMS officer.
First, indicate to whom this notification is addressed.
We begin filling out the application for dual citizenship with information identifying the person. Only those places in which dashes are placed are filled. For example, the word "I" goes, and then there is a dash, we enter the full name of the name there. and date of birth.
- Place of residence: indicate the zip code and full address indicating the region, district, settlement, street, house and apartment numbers. The place of registration is indicated on the passport, in the absence of such - the place of stay, in the absence of such - the place of actual location.
- We indicate the series, number, date of issue and the authority that issued the identity card of an individual holding Russian citizenship.
- We indicate which country is the second citizenship, indicate the same details as for the Russian passport, with the exception of the issuing authority. It also indicates the same details in relation to the document on the right of permanent residence abroad.
- We indicate the date and reason for acquiring citizenship of another state. For example, upon obtaining Tajik citizenship, one of the grounds may be "as a result of admission to citizenship." It also indicates the same details in relation to the document giving the right of permanent residence abroad.
- We indicate how long the document on the right to permanent residence abroad has been extended, or information on the receipt of a new document giving this right.
Clause 6 is filled in if an appeal has been sent to the appropriate body of a country located abroad about withdrawing from the citizenship of a given state or about refusing a document granting the right of permanent residence in it.
On the flip side of the dual citizenship application form, the applicant fills in only the top lines, which indicate the number of application sheets in paragraphs. 2-3 (which include copies of documents), puts its signature and transcript at the top.
After filling in the remaining part with the FMS employee, the applicant puts the number and signature below on the back of the form.
The detachable part is given to the applicant or his legal representative and serves as confirmation of receipt of the application for dual citizenship.
Differences in filling out the application for minors and the legally incompetent
Consider the features of the sample application for dual citizenship with the participation of a legal representative.
After the word "I" on the front side after the title, information identifying this representative is indicated. It also indicates his identity card with details, place of residence / stay / actual location. Below is indicated the legal representative of who he is, indicating his identification data (name), date and place of birth.
In paragraph 2, for children under 14 years of age, another document is indicated, as a rule, a birth certificate.
The remaining items are the same as in the general statement.
The back also indicates the number of sheets of applications, but here they are already referred to, in addition to those listed in paragraphs. 2-3, documents confirming the authority of the representative and a copy of his identification card.
After filling in by the FMS employee, at the end the number and signature are put by the representative. The rest of the procedure for applying for dual citizenship is the same as in general.
Date and Place of Notification
In general, the deadline for submitting a notification of a second citizenship for a citizen with a permanent residence in the territory of the Russian Federation is 60 days from the date when an identity card of a foreign state was received.
You can apply at the FMS or at the MFC in the "My Documents" window.
When sending through the use of mail, it is imperative that you or your representative be present there, since the mail employee will need to verify the identity of the sender. In this case, the tear-off coupon is filled by him, and not by the employee of the FMS. Do not forget to indicate the address where you should send a notification from the FMS on the acceptance of documents.
Punishment for failure to provide information
If the notification was filed at the wrong time with distorted information or false information, the person who submitted it is subject to a fine, the amount of which is 500-1000 rubles.
If it is proved that the notice is not presented intentionally, the fine may increase to 200,000 rubles or compulsory work may be imposed up to 400 hours.
