Administrative fines: their enforcement and statute of limitations

Amounts of unpaid fines in Russia amount to more than one billion rubles. There are offenses, but there is no payment. Administrative fines are a monetary penalty and punishment for administrative violations, of which there are more than 20 types. In addition to punishment, the fine is designed to fulfill the function of compensation for harm caused by the violation, as well as a preventive (warning) measure.

Punishments of this kind do not apply to:

- military men undergoing military service;

- cadets of military vocational schools;

- teenagers (up to 14 years old). Parents are responsible for them.

Payment procedure, sanctions in case of non-payment

Administrative fines are paid in a month. The countdown starts from the day they were discharged. A fine directed against a citizen may not exceed 5,000 rubles. In case of punishment, officials may lose up to 50,000 rubles, and a legal entity - up to a million. If the punished person does not pay on time, the fine may be doubled. And if he does not pay again, then a person can be arrested up to 15 days.

After administrative fines are paid, the violation is considered completed.

According to the law, another month will pass before the bailiffs take any actions against those who have not paid the fine. After this period, the bailiffs receive a document from the court on non-payment and all materials in order to work further to receive money in the budget. A new protocol is being prepared stating that another offense has been committed - no fine has been paid. A copy of the protocol is sent to the court.

Thus, without paying administrative fines in the amount of 1 to 5 thousand rubles, a person receives another fine in the same amount, runs the risk of being arrested, loads legal proceedings with redundant papers, and in addition falls into the hands of bailiffs. They have the right

- prohibit travel outside of Russia;

- freeze bank accounts;

- to seize the car, property and other property of the debtor in order to realize it and ensure payment of the debt.

The practice of arrest imposed on a car is widely used for fines imposed by the traffic police.

Further, the necessary actions are taken by the court and bailiffs, which supplement the penalty with another 7% of the fine (but not less than 500 rubles) and give the debtor another 5 days in order to finally pay administrative fines.

A simple example: if a citizen is fined a fine of 200 rubles, then if he fails to pay it, he will be doubled, then the fee for the execution and execution of the case will be doubled for 500 rubles, total - the total amount will be 1600 rubles. This is already a sufficient amount in order not to be allowed abroad and seize property. It’s easier to go to the bank and pay a fine, spending a maximum of half an hour on the procedure.

Deferred payment options and payment notification

The fine must be issued in accordance with the rules of execution of the decision. If they are violated, the citizen has the right to file a complaint with the court. The actions of employees who wrote a fine may also be appealed if they were unlawful. You can write a statement to the court on the postponement of the execution of the decision, ask for installment payment (for a period of three months).

A copy of the payment document does not need to be submitted anywhere. But since the documents take a long time, and you have a trip abroad, do not be too lazy to make a note about payment and save the receipt.

Continuing administrative offense

The concept of an offense, which is attributed to lasting, implies a violation that has a long period of time. That is, in the past the law has been violated and is currently being violated. This is a long and ongoing crime. From what the offense is, the period from which the countdown begins. If the violation refers to the category of lasting, then the calculation of this period in relation to it is suspended.

The limitation period for administrative offenses is one year. But the restriction on departure may last longer than this period, depending on the time the restriction order is issued.
