Recently, cameras for detecting traffic violations have become widely demanded in Russia. With regard to this change, car owners have a lot of debate regarding the functions of automatic systems. Can they strip the rights of the video recording camera? The answer to this question is presented in the article.
Types of Violations
Autofixation cameras of violations in Russia began to be used in the zero years. And although from a technological point of view, these devices are developing slowly, now thanks to them various violations of traffic rules are detected.
For what offenses do you lose your driver’s license? This is allowed in the following cases:
- The intersection of railways - when the barrier is closed or when closed, to a yellow (red) light.
- Over speed. In this case, the excess value is important. For example, when traveling under the sign "Limit to 40 km / h" at a speed of up to 60 there will be no penalty. Deprivation of rights for four to six months will be a punishment if exceeded by 60-80 km / h. For larger excesses, a fine of five thousand rubles may be imposed. If the violation is repeated, then they are deprived of their rights for a year.
- An oncoming trip with a preliminary intersection of continuous axial.
- Secondary non-observance of traffic rules, which do not allow passage through intersections to the red or yellow traffic signal. But there are exceptions to this violation. About them it is said in paragraphs 6.13-6.15, 13.7 of the rules, as well as in part 1 of paragraph 3 of Art. 24.5 Administrative Code of the Russian Federation. In the latter case, it concerns traffic to a prohibitory traffic signal in case of urgent need, when, for example, the driver drove a person to the hospital.

How is the procedure carried out?
Do video recordings lose their rights? Withdrawal of a driver’s license is allowed only by judicial decision. No one has the right to select a document before a judge decree. The procedure for canceling documents is carried out according to a simple scheme:
- The police fix the offense.
- A protocol is being drawn up.
- Materials are submitted to court.
- The question is considered by the judge.
- A decision is made.
- The decision is passed to the violator of the SDA.
- Ten days are given to appeal the decision.
Only then can the certificate be withdrawn. In this case, the camera complicates the process, since after automatic fixation there is no possibility of drawing up an offense protocol.
Auto lock
There are several types of cameras and radar systems on modern roads. But not all violations are automatically recorded. Can they be deprived of their rights by camera? There are several violations that can be fixed in this way. It refers to:
- speeding;
- a trip without wearing seat belts;
- driving to the oncoming lane;
- movement in the passenger section;
- moving stop lines;
- average speed of movement, even if there was braking in front of the camera.
In the future, the traffic police plans to introduce software in radars and cameras that will allow to record an offense when vehicles do not stop before a pedestrian crossing. Then the camera of video recordings of violations will have more opportunities.
Do jammers work?
Camcorders located on the roads operate continuously. Unauthorized disconnection for a while will not work. But there are methods of jamming cameras on banks, car parks. Jammers from traffic police cameras disable Wi-Fi, 4G or 3G, but they are useless on highways.
Video cameras placed on poles do not function according to the principle of response to opening doors, breaking ATMs, or moving. They constantly show a picture of the movement of cars. It will be possible to identify with them, for example, how the driver violated the rules of rebuilding, ignored the double continuous dividing strip. The fact of violation is transmitted to the information processing center.
You can’t use a jammer. A device that removes a compromising file will lack the speed to perform an electronic maneuver. To prepare the start, the jammer needs about ten seconds. It turns out that the object under investigation will pass faster than the jammer works. The car must go at a lower speed. Then it will not be necessary to jam, since the object does not violate traffic rules, which is required for traffic police.
But there is a way out. If you use devices that suppress signals about the location of the machine, it will be difficult for the video fixture to set the speed of the vehicle.
Punishment
Since an automatic system may have an error, a risk of error, and software failures, there are features between liability measures. Can they be deprived of their rights by camera? The court takes into account private situations:
- The camera has the necessary certificate for the establishment of an offense.
- Circumstances in which an administrative offense was committed. For example, the driver will definitely be fined when leaving the stop line. But when he performs a maneuver, skipping an ambulance, then this violation is disputed and the fine is canceled.
- Serviceability of the camera.
Within ten days after receipt of the receipt, the violator may file an appeal to review the case. In this case, the decision may be changed.
Fine
If the speed video camera has found a violation, penalties are provided. The penalties approved by the Administrative Code differ depending on the severity of the offense. For example, for a speed violation of more than 60, but also up to 80 km / h a fine of 2-2.5 thousand rubles is levied.
Traffic police officers are able to punish the driver based on the details of the offense. But an automatic system cannot do that. Therefore, the program includes that, if a violation is detected, it will establish a minimum penalty.
Deprivation of rights
Now a fine is being issued for taking rights from the camera or on the testimony of the radar. If the Administrative Code indicates only deprivation or another punishment that is not related to the fine, the culprit must pay a receipt for five thousand rubles (part 3 of article 28.6). As a result, deprivation of custody is not prescribed by law. Even after fixing the violation, it is forbidden to impose other non-financial penalties in the form of:
- obligatory work;
- administrative arrest;
- confiscation of transport.
The camera is much more loyal to the traffic police. But the automatic system cannot forgive the intruder. And you should also distinguish between cameras of automatic fixation and recording devices, which are assistants to the traffic police.
Sometimes there are cameras at the posts that are inspected by an inspector on duty in the direction of travel. These devices are not able to write a fine, but based on the record, the police officer is able to stop the driver. The offense will be processed and the fine will still have to be paid. Therefore, drivers need to regularly monitor camera offenses.
Check
If the fine is not paid in a timely manner, it is transferred to the bailiffs. And on the overdue repayment restrictions are imposed, for example, a ban on leaving the country. In order to prevent additional financial expenses, it is advisable to track violations using the database of the Ministry of Internal Affairs. You can use it through the traffic police website. Debt is checked through "State services", a portal of the bailiff service.
To get comprehensive information, enter the numbers of documents or determine the penalty by the number of the decision. It should be borne in mind that the Ministry of Internal Affairs base is not updated immediately. Information about the fine arrives on the site when materials from the radar or camera are processed in the traffic police service center, and this takes several days.
