When making a purchase, you should always carefully consider the purchased goods. A defect that is not immediately noticed can cause a bad mood and a conflict with the seller. All problems arising before or after the acquisition of goods can be roughly grouped into two groups:

1. The problem caused by the non-compliance of the quality of the goods with the requirements specified in the documents attached to it.

2. The problem is when the product for some indicators did not fit or did not like the buyer upon closer examination.

In this matter, the law “On the Protection of Consumer Rights”, published back in the 1990s, comes to the aid of citizens. It contains a large number of tips and recommendations for resolving conflict situations that have legal force. Any issue can be resolved by knowing the duties and rights of both parties. The peculiarity of this legal act is that it allows you to resolve relations between the parties that arise both in the process of acquiring the goods and after making a purchase. The first thing that the buyer should do when a claim arises is to write a statement for the return of the goods. Without this paper, an oral story will look unfounded and unfounded. Such an application for a return of goods can be written in any form, but must contain 4 main points:

1) Details of the seller (its name and location).

2) Buyer details (surname, initials, passport details and contact phone number).

3) The text of the application (detailed information about the circumstances of the purchase and the essence of the requirement).

4) Date of application and signature of the originator.

The application for the return of goods must be taken to the store and transferred to the head, senior seller or the person responsible for working with citizens. The document must be made in duplicate. One is transferred to the seller, and the second remains with the buyer. To confirm the fact of submitting the application, it is necessary that the store representative noted on the second copy the date of receipt of the document, as well as indicate his name, position and signature. Now, an application for return of goods has become an official claim, which must be considered within three days.

If the buyer had a chance to buy goods in the store that did not match the quality, then it can be returned back without any problems. The seller must accept the defective item and return to the citizen the money spent on its purchase. For its part, the buyer should contact the seller with a corresponding request. It is made out as an application for a refund for the goods. The document is written in any form in the name of the head of the seller company. The text provides a detailed description of the moment of purchase (when, at what price) and lists all defects of the goods found during operation. If the goods have undergone warranty repairs over the past time, then this should also be reflected in the statement. Such a request may be submitted only when the warranty period for the goods has not yet expired. In conclusion, it must be pointed out that on the basis of articles 18, 19 of the Law on the Protection of Consumer Rights, you want to return the amount of money in such and such amount spent on the purchase of defective goods. From the moment of filing such an application, the store must resolve the issue of refund within 10 days. This is provided for in article 22 of the same Law. And article 23 states that for each day of delay the seller must pay a penalty, which will be 1 percent of the value of the goods. You can also warn the seller that if you ignore this statement and do not comply with legal requirements, you will be forced to go to court. After this, it remains only to wait for the result of the resolution of the issue.

Take, for example, clothes. Arriving home, the man once again tried on a thing and realized that it did not suit him at all. Perhaps he was not satisfied with the color scheme or size. In this situation, the buyer may ask to replace the product and give him the exact same thing, but of a different color or size. If there is no such product at the time of contacting the store, he may be offered any other choice with a subsequent recount of the price. Section 25 of the above Law does not contradict this. The most important thing is that the purchase object meets two requirements:

  • was a product of a non-food group;
  • not included in the number of goods not subject to return.

If all conditions are taken into account, then the issue will be resolved in the interests of the buyer.
