In life, there are often situations when a person does not want or is not able to do some work. In this case, he needs an assistant ready to take on the discharge of these duties. The situation is quite delicate and requires full trust between the parties. For these purposes, the Civil Code provided for the possibility of drafting a special document of a certain form, which would allow one side to represent the interests of the other before the third. Such a paper is called a “power of attorney”.
Document Purpose
One of the areas of application of such a document is a power of attorney to receive mail. It can be made up:
- between individuals;
- between employee and company manager.
Both of these cases are worth considering separately. Take, for example, a large manufacturing enterprise. A large number of letters, parcels, or parcels usually come to the organization’s address or personally to the name of the head. Correspondence comes from partners, suppliers, public organizations and individuals. Information or administrative documents, securities, as well as statements and complaints of citizens are sent by mail. All of them must be received at the post office, and if the document is custom-made, then it is necessary to sign for it in a special form. All these procedures take a lot of time. It is clear that the leader will practically not be able to do this. Otherwise, he will not have time to perform his direct duties. For these purposes, a power of attorney is drawn up to receive mail, in which the execution of this work is entrusted to one of the employees of the company. The director may be absent from the workplace or may be on a business trip or on vacation. At this time, on the basis of the compiled document, all mail arriving in his name will be received by an authorized representative. On the other hand, any citizen can draw up a power of attorney to receive mail. There are times when such a document is simply necessary. For example, if a person is sick and cannot personally visit the post office to receive an important letter or parcel. Then he is forced to seek help from another person. But for this, the trustee must be endowed with special powers that allow him to act in the interests of the principal. For this, a power of attorney is drawn up to receive mail or other correspondence, which should be certified by a notary.
How is the document compiled
In enterprises, correspondence is usually handled by the secretary or office administrator. A letter of attorney for receiving mail is drawn up in his name, one copy of which is transferred to the post office, and the second is stored at the enterprise. There are certain rules for the preparation of such a document:
- The power of attorney is issued on company letterhead.
- In the center is written the name of the document, and a little lower the date of compilation.
- Next is the text that indicates the name of the organization and the details of the head (principal): his full name, position and passport information.
- Then there are the details of the employee (proxy): and his passport details.
- Next, all his powers are prescribed.
- After this is the signature of the employee.
- Validity period of the power of attorney.
- The signature of the head, certified by the seal of the enterprise.
Receiving registered mail
An authorized employee, having a properly executed document in hand, can receive any correspondence with the exception of valuable correspondence at the post office. And it doesn’t matter how much it costs. Even if the letter is valued at one ruble, it can only be received by the addressee personally, holding a passport. The proxy is entitled to receive all other securities. He does not need a separate power of attorney to receive registered mail and ordinary. One standard document is enough. And so that there is no doubt about the legality of rights, it is necessary to indicate in the job description of the employee that he is responsible for receiving mail that comes in the name of the company. There are situations when ordinary letters are brought to the office, and registered letters must be received by mail. In this case, the power of attorney is made specifically to receive registered mail.
