A public hearing is a process of discussing draft municipal regulations on local issues with the participation of members of the urban community. They are carried out in accordance with the Basic Law of the Russian Federation, the charter of the city, applicable law. The results of the discussions are advisory in nature.

Discussions are carried out in accordance with a voluntary, free and equal expression of will. Public hearings are held publicly. Each member of the urban community has the right to know about the place, time and day of discussions, as well as issues submitted to them.

Drafts of the Charter of the city, decisions of the City Council on introducing amendments or additions to it must be submitted for discussion. At public hearings, questions are raised about plans for the appointment of city budgets and their implementation. Draft programs for the development of the city, land use and development rules, territory planning, land surveying, as well as questions about granting permission for the conditionally permissible use of capital construction objects and land are put up for discussion. The hearings discuss the problems of transformation of the municipality, other draft normative acts of local importance.

Schedule discussions

Public hearings can be initiated by members of the city society, the mayor of the city, or representatives of the Duma. In the latter case, discussions are held on the draft Charter, issues on making additions or amendments to it. The mayor of the city initiates a public hearing to discuss the budget, a report on its implementation and draft programs and plans for the development of the city. The City Duma appoints meetings on its own initiative or at the will of the members of the city society. The mayor decides to conduct discussions on his own.

A group of at least one hundred people, each of whom has the right to vote, may propose discussions . The initiators submit to the City Duma a statement indicating the draft municipal normative act, as well as the name, patronymic, last name, phone number, address of the authorized representative taking part in the discussion of the application in question. It also provides a list of group members, the minutes of the meeting, at which a decision was made to put forward the issue of holding discussions and appointing a representative. All documents must be signed by the secretary and the chair of the group meeting.

Procedure for considering applications and making decisions on holding public hearings

Consideration of proposals to hold discussions on the issues presented is carried out at a scheduled meeting of the City Duma in accordance with established regulations. A representative of a group of initiators has the right to speak at a meeting to justify the need for a public hearing. In accordance with the results of the consideration of applications, a decision is made to schedule discussions or to reject the application, indicating the reasons.
