Probably, most drivers had situations when they had to violate traffic rules and drive without compulsory motor third-party liability insurance. According to current regulations, a fine is imposed for the lack of insurance. Regardless of whether the MTPL policy was forgotten at home, whether it is expired or even absent from the driver, this is an offense. It turns out that it all depends on the driver. For example, he may ask someone close to bring up a policy or go for it on his own, leaving the car at the traffic police department. But if there is simply no time for this, then in the drawn up protocol in the corresponding paragraph, it should be noted that the driver does not agree with the decision of the traffic police officer, since in fact the insurance policy exists, but it was forgotten at home.

In this case, it is possible to pay a fine for the absence of insurance in the amount of 500 rubles. However, you should prepare for additional chores. Still, you have to drive up to the traffic police department together with the policy and write a statement that they revised the article of the Code of Administrative Offenses, according to which they brought to administrative responsibility.
But if the traffic police officer is in a good mood, then maybe the driver will be able to get by with an oral warning, and then go home for the policy.
If the driver does not specifically carry the policy with him, for fear of losing it, then you need to at least carry a photocopy of the document in the glove compartment. The traffic police fine for the lack of insurance still have to pay, but there will no longer be a dispute about which article qualify the offense, and you need to pay only 500 rubles.
Riding without insurance
Once, in 2008, you could safely ride without a policy for a month after the previous policy expired. It may seem strange, but today there are drivers who innocently believe that this rule continues to apply.
However, this is not the case. Even if several minutes have passed after the previous MTPL expired , a traffic police officer who stopped the driver qualifies such a ride as an offense. What punishment will follow? The fine for the lack of insurance in this case will be equal to 800 rubles.
Whatever circumstances the driver has prepared for explanation, they will not help. In addition, one should not forget that the policy is no longer issued without inspection. And therefore, you should prepare in advance and take care to receive both documents on time.
The only circumstance that justifies driving without insurance is to buy a car less than 10 days ago.
Expired Insurance
What a penalty for the lack of insurance follows, we found out. Let's now imagine that the insurance policy exists, but it is expired. From the foregoing it is clear that this too is an offense. However, what punishment will follow? An expired policy is equal to its absence. Therefore, the offense is qualified by Article 12.37 of the Code of Administrative Offenses, part two, and is punishable by a fine of eight hundred rubles.
Thus, a bad memory in this case will result in not very pleasant consequences for the wallet. Therefore, it is best to remind yourself in a couple of weeks how the policy expires, the need for replacement.
The driver is not insured
It also happens that the one who drives the car is not included in the insurance policy. Then, despite the current OSAGO, the fine still has to be paid. Moreover, this obligation does not even concern the driver, but the owner of the vehicle. After all, he entrusted his car to someone who is not included in the insurance document. And therefore, he should be responsible for these actions.
For such an offense will have to pay 500 rubles. If other persons are supposed to drive the vehicle, then they should be indicated on the policy. Even if initially it is issued only for one driver, it is not difficult to re-register it. To do this, itβs enough to come to the office, pay the difference and get a new CTP.
Some craftsmen, however, are trying to quickly draw up a power of attorney at the moment when the traffic police officer who stopped the car approaches it. Of course, you do not need to certify it with a notary, and enough paper filled in by hand. However, given all the points that should be contained in it, it is unlikely that in such a short time it will be possible to draw up everything correctly. The power of attorney for driving should ideally contain:
- passport data of vehicle owner;
- information about the car;
- passport details of the driver to whom management is entrusted;
- intended actions with the car.
So much needs to be written so that for the traffic police officer the document seems convincing enough. Therefore, if a one-time trip is planned with a driver who is not included in the policy, you need to take care of this and draw up a power of attorney before the trip.
Attention: seasonal insurance policy
The usual period for which insurance is issued is one year. But if you do not intend to operate the car all year round, then you can draw up a seasonal document. However, at the same time, if it does happen that the driver needs to go by car and the traffic police officer stops him, he will be punished similarly to how much (the penalty for the lack of insurance) offenders pay, that is, 500 rubles. And such payments will have to be made every time the driver is stopped.
