In life, it sometimes happens that things of inadequate quality are acquired or for various reasons they may not suit the buyer. In such situations, the law allows the consumer to contact the seller and return the goods of inadequate quality or exchange them for a similar one.
However, the buyer's right to exchange goods is exercised only on condition that the thing does not fit in shape, dimensions, color, style, composition or size. It is these reasons that should be discussed with the seller when contacting him, otherwise he may refuse to satisfy the buyer's requirements.
Another condition is the return of goods of inadequate quality within 14 days. This period includes calendar days, including holidays and weekends, and the day of purchase is not taken into account. In the event that the last day of the exchange is non-working, you can return the goods of inadequate quality on the next business day.
When returning a defective product, it is necessary to take into account that it will be changed only if it was not in use and it retained consumer properties, seals, presentation, factory labels, and also there are documents that confirm payment. If a sales receipt, cashier's check or other payment documents are not available, then in a similar situation it is possible to return the goods, although in this case evidence will be required and it will be necessary to prove their validity.
If the purchase must be exchanged for an analog or a return of goods of inadequate quality is made, then it should not be in the list of goods not subject to exchange. This list includes perfumes and cosmetics, medicines, medical instruments, hygiene and sanitation items, textiles, decoration and building materials, cable products. In addition, this list includes knitwear and clothing, tableware and kitchen utensils, products and containers intended for food storage, pesticides, agrochemicals, chemical household goods, and household furniture. This also includes precious metal products and jewelry, electronics and household appliances, duplicating devices and computer equipment, woodworking and metal cutting machines, bicycles, motorcycles, cars, animals and plants, albums and book publications.
This list of goods is exhaustive and the seller has no right to expand it at his whim. By exercising the right to exchange, or if a claim is made for the return of goods of inadequate quality, the buyer is not obligated to reimburse any costs. In the absence of the necessary quality goods, you can return by receiving the money paid for the goods.
In order to exchange or make a return of goods of inadequate quality, you must have a passport with you: in most stores it is required to complete this procedure, and other documents may not be accepted. If the buyer refuses the goods of ordinary quality, the seller returns to him the amount that was paid under the contract, excluding the costs of the seller for the delivery of goods from the buyer to the store. At the same time, a period of ten days is established from the moment the buyer claims the corresponding requirement.
The rules for the sale of certain categories of goods contain a list of documents that must be executed during the implementation of the return, as well as all methods of returning the money paid. If goods of good quality are returned, they draw up an invoice or an act, and the money is transferred to a bank or other account that the buyer indicates. In this case, the seller shall bear the costs of refund of the amount of money, it is possible to carry out the refund by postal order.
