The reader is presented with a little material on the competent compilation of various statements from consumers. This may be a claim on the product, its quality. Or a claim for a refund for low-quality service. The article will also provide a sample claim.
Claim Characteristics
Claims may be made due to the poor quality of the product, which has significant disadvantages in its consumer characteristics. Another reason for writing a claim for a refund may be a failure to meet the deadlines for the fulfillment of the agreement or poor quality of performance of tasks or prepaid services. By writing it and indicating at the same time all the evidence of non-compliance with the conditions, you can demand a refund.
Complaints are distributed according to types and categories. The characteristic features of the presentation of conditions within the agreed time are taken into account.
Claim Types
There are two types of claims:
- Complaints against merchants of food or goods;
- complaints about the performer of tasks, work, or services.
Such examples of complaints are also consistent with the rules on the application for the return of products of good quality. Consumer rights allow such actions. But such statements for the most part reflect the most common cases of non-compliance with the expectations of the received goods or services. If your situation does not correspond to any of our examples, then it will be the best decision to turn to specialists.
Claim for goods
A product return request may be required at any time. Not a single person is insured from receiving a low-quality or damaged product. In order to make a claim (a sample can be seen later), very little is needed - decisiveness and confidence in their rightness, understanding of individual laws and a number of necessary recommendations, which will be given below.
Sample return claim
When making a claim, pay attention to the following points:
1.Paper must be in duplicate. One of them is handed to the merchant, the second with the assessment of receipt of the goods remains with the consumer.
2. Be sure to specify the date and time of receipt of the goods, as well as the purpose of the purchase.
3. Describe the product: its name, brand, shape, tone or color, volume, assembly, type, serial number, etc. All data should be indicated if they are known to the buyer.
4. It is necessary to write about the duty of the merchant to examine the goods themselves and make sure of its flaws.
5. Refer to the relevant provisions of the law that oblige you to accept defective goods (we are talking about article 18 of the Law on Consumer Rights, article 309 of the Civil Code, article 310 of the Civil Code and article 503 of the Civil Code).
In the event that we are talking about a large-sized item (weighing more than five kilograms), the claim must include the method of its delivery to the buyer.
Claims Terms
The consumer has the right to return to the distribution network not only defective goods, but also products of inappropriate quality. But if we are talking directly about the complaint, then this definition applies specifically to low-quality products. In a different situation, it is best to make a regular statement. You can see the sequence of points and a claim model in the article.
Law number 18, referred to above, is called “On the Protection of Buyers' Rights”. It says that if, after purchasing the product, the consumer noticed flaws in it, then the buyer has the opportunity to return the product to the outlet. After the return of the goods, the value of the goods must be refunded or a new high-quality similar product should be issued.
Typically, such issues should be resolved from 7 days (replacement of goods) to 20 days (replacement with additional quality control). To satisfy the claim for a refund, 10 days are allotted.
