What is a criminal record
A criminal record is the state of a citizen convicted of committing a crime in a court of law if criminal correctional measures are applied to him (punishment). In other words, if a person’s punishment is abolished, he is considered not convicted.
A criminal record entails certain legal restrictions. This is a ban on engaging in certain types of activities, and occupying certain positions, and traveling outside the country. However, even if a person has a criminal record, and a passport cannot be obtained, you should not be upset, because this phenomenon is not permanent: the law provides for a mechanism for extinguishing a criminal record.
Withdrawal and repayment of criminal record
Redemption of a criminal record is the termination of its effect and the annulment of legal consequences, carried out automatically. Different crimes have different maturities regarding the completion of the sentence:
- in conditional punishment, the criminal record shall be repaid immediately;
- with softer punishments than imprisonment (for example, fines) - after a year;
- upon conviction for crimes of a small degree of gravity - after three years;
- when committing a serious crime - after six years;
- if the crime was especially grave - after 8 years.
Among other things, a criminal record can be redeemed before the expiration of the specified time in court in the case of impeccable behavior of the convicted person, as well as as a result of amnesty.
It is enough to remove a criminal record, and a passport can be obtained in the usual manner. However, a citizen needs to take a certificate from the police department at the place of residence stating that his criminal record has been withdrawn (canceled). You can apply for it personally (through a representative) or through a written application (by mail). The obtained certificate must then be submitted to the city police department to correct data on the repayment of a criminal record.
Where do you apply for a passport, what documents are needed to obtain it
A passport can be issued at the FMS at the place of registration or actual residence, at the Ministry of Foreign Affairs and its representative offices, at consular offices and diplomatic missions. In addition, you can submit an online application on the Single portal for the provision of state and municipal services.
The “passport” for people with a criminal record and the passport for the rest of the citizens of the Russian Federation practically do not differ in the set of necessary documents. It will be necessary to provide:
- Russian passport;
- originals and copies of birth certificates of children under the age of 14;
- application for a "foreign";
- receipt of payment of duty and forms;
- 4 photos (the necessary parameters of the photo must be found in advance at the place of registration of the passport);
- a certified copy or original of the work book;
- men of military age - a certificate from the military registration and enlistment office;
- certificate that the existing criminal record has been canceled;
- and a passport issued earlier (with an expired date).
The deadline for issuing a passport when applying at the place of registration does not exceed one month, at the place of stay (when the residence is temporary) - four months. If there is a documented need to obtain a document due to the urgent need for treatment, as well as the death of a close relative abroad, the issuance of a passport should not exceed three days.
