Any tenant is obliged to create safe working conditions for the personnel of his enterprise. The organization must apply the OT rules for the direct operation of office machinery and equipment in workshops, for the implementation of technological operations, etc. For this purpose, an OSH management system is created at the enterprise.

OSHMS is a combination of certain measures, interconnected elements that provide a unified policy and goals of a particular enterprise in the field of labor protection. It is necessary, first of all, to eliminate the risk to the health and life of the companyβs personnel, to prevent accidents and accidents that have serious consequences not only for the employer and employees, but also for the entire organization. For the implementation of measures, a standard Regulation on the OS management system should be approved. It is valid throughout the enterprise, in all offices, premises, buildings, structures that belong to the employer. The OT requirements are mandatory for all personnel, as well as third parties located on the territory of the organization.
Regulation on the OSH management system
The OSHMS of a particular enterprise is being implemented in accordance with a local act. The employer develops it independently. At the same time, he takes as a basis a new Model provision on the OT control system . This document was adopted by order of the Ministry of Labor No. 438n of 08/10/2016. To draw up a local act, the head of the company can attract outside organizations or employees of other (specialized) companies. Approval of the Regulation is carried out taking into account the views of employees or representative bodies (if any).
Document structure
The first and one of the required elements of the document is the title page. The name of the act, the name of the enterprise, the full name of the employees involved in the development and approval are indicated here. In addition, the Model Regulation on the OSH management system includes the following sections:
- Common. It describes the purposes for which the model Regulation on the OSH management system is adopted, what exactly it establishes, what norms formed its basis. It also indicates the frequency of revision of the document.
- Describes the distribution of responsibilities between employees of the company on health.
- Defining the departments of the company responsible for OT. It must be said that a document regulating their work should also be provided for them. For its compilation, the Model Regulation on the Occupational Safety and Health Service is used .
- Regulating staff training, special training on health and safety. In particular, in this section the categories of employees who are required to undergo training are specified, its duration and frequency are established.
- The determining order of testing knowledge of OT.
- Establishing measures aimed at improving the OSH management system .
- Determining the order of actions of employees in case of an accident or other emergency, the rules for responding to incidents.
- Establishing responsibility for failure to comply with established requirements for occupational health and safety at work.
The model regulation on the OSH management system also contains annexes. They can display graphical diagrams, tables related to health and safety at work. Applications may also contain a magazine in which employees confirm with their signatures that they are familiar with the established rules. The text of the document itself should contain references to certain additional acts.
Distribution of duties
It is necessary to ensure the effective implementation of established activities. The standard regulation on the OSH management system establishes the following obligations for the employer:
- Organization of work focused on maintaining the health and life of employees.
- Creation of working conditions that comply with legal requirements.
- Allocation of necessary resources for the implementation of the envisaged OT measures
The employer should share responsibility for security issues at all levels and in all departments, including in the framework of support services. The latter, in particular, include administrative, financial, personnel and other departments.
Personnel Responsibilities
The model regulation on the OSH management system does not establish specific tasks for this or that employee. As a rule, the document contains references to other local acts. Specific responsibilities, in particular, are provided for in the Labor Code, as well as job descriptions. In the Model Regulation more attention is paid to the labor protection service and to the specialists working in it. The head of the enterprise organizes the activities of this unit, determines the number and structure, in accordance with the requirements of Article 217 of the Labor Code, as well as regulatory acts of the federal executive branch. The duties of the chief and service specialist are prescribed in the qualification characteristics and instructions.
Staff training
To achieve maximum efficiency in the implementation of OSHMS, the director of the enterprise is obliged to provide continuous training, including special training and advanced training for all employees. Personnel training is carried out taking into account the work performed. Training and subsequent testing of knowledge is carried out in the manner determined by the authorized federal institute of executive power, regulatory acts in the field of health and safety.
Internal exchange of information
Ensuring timely collection, proper processing, storage, transmission of information on labor protection, their updating allows us to analyze them and make decisions aimed at improving OSH. The company should have developed and documented a procedure for exchanging OH&S data between departments. It necessarily describes the following elements:
- The rules for the approval and revision of local acts on health and safety conforming to the requirements established by the federal executive body.
- The order of consideration of applications of employees, proposals coming from them on issues of improving OSH.
- Rules for the formation, generalization, placement, updating of the information base on the territory of the enterprise. This, in particular, is about the procedure for updating visual aids, stands, posters, documentation on occupational health, requirements for ensuring the sufficiency of these materials, the availability of places for their placement, etc.
Documentation
The organization, implementation and ensuring the effective functioning of the OSHMS involves the formation of a set of interconnected local acts that describe the structure of the system, the rights, responsibilities of each unit, specific performers, and the processes of ensuring environmental protection and supervision. Documentation may be in the form of enterprise standards, management, or other types. The set of OSH acts is minimal, but sufficient to ensure the functioning of the system.

They are a special type of document that is not subject to revision, updating and updating. No entries are allowed in the entry. Employees should have access to documentation related to production processes and ensuring the safety of health in their implementation. The head of the company determines the employees responsible for keeping records.

The OSH documentation should:
- Periodically analyzed and adjusted (if necessary).
- Be accessible to employees whom it directly concerns and to whom it is intended.
Copies of acts are recorded and placed in places that are accessible to staff. Canceled documents must be withdrawn from circulation. At the same time, measures are being taken to exclude their subsequent unintentional use. Currently, the legislation does not clearly define the time period in which the Regulation on OSH management system should be adopted at the enterprise. Meanwhile, inspectors check the availability of documentation and its adequacy. For the absence of an OSH, the manager may be held responsible for the Administrative Code.
