The concept of technical regulations

For a long time in Russia, the main evidence of quality was compliance with the requirements of the GOST R system. However, at present it has lost its former strength, and Technical regulations are being developed in its place.

This document is a normative legal act in which the requirements that are binding are approved. A federal law “On Technical Regulation” has been adopted, which coordinates this issue. According to him, the objects to which it applies are works, services, organizational systems, buildings and structures, products and more.

Only Technical Regulations are binding. All other legal acts are voluntary.

Goals and objectives of the regulations

Regulations are primarily aimed at security. In accordance with this task, they protect the life and health of people, animals and plants, the environment and property. In addition, they provide energy efficiency and prevent consumer fraud.

There are TR national and Customs Union. A certificate of conformity with the Technical Regulations should be carried out in relation to:

  • harmful emissions by automobile, river, sea transport and from the operation of equipment of various fields of activity;
  • food products;
  • tobacco products;
  • gas networks, as well as equipment operating on gas.

For other purposes TPs are not accepted.

TR TS instead of GOST R

In 2010, the development of national regulations was suspended, as it was decided to gradually replace them with TR for the Customs Union. The received certificate of compliance with the Technical Regulations for the CU is currently valid in the territory of all participating countries, and it needs to be issued only once.

In 2011, the CCC Decision was adopted under number 563. According to the document, a single form of a certificate of conformity and a declaration on the territory of the Customs Union was approved. Then Decision No. 711 approved the single sign of circulation (EAC). Since 2014, it has become mandatory for goods covered by the Technical Regulations.

In 2011, the most important TRs for the Customs Union were developed. They contain 47 object groups with the same number of lists. Following the development in a short time, first requirements for pyrotechnic products came into effect, and then children's toys, cosmetics and perfumes, light industry for teenagers and adults, and the rest.

The development of the TR is based on existing documents of a national scale. But each of them nevertheless goes through all the stages of coordination. Indeed, in different countries, the Technical Regulations may contain different requirements for safety and quality, which, at times, contradict each other.

From the moment the TR CU program began to be implemented, this document became necessary along with the declaration of conformity. The certificate of conformity to the Technical Regulations of the CU is received only in those bodies that are accredited to carry out appropriate actions, as well as permission to issue such documents. In addition, they should be included in a single register of certification centers. Registration of the vehicle certificate is carried out by providing test reports conducted in the respective laboratories. But, some schemes allow the receipt of a declaration of conformity without test reports being provided.

This type of document has the same legal force as a certificate. It confirms the fulfillment of all the conditions of the Technical Regulations for products. The difference from the certificate in this case is that for everything stated in the declaration, the applicant is responsible. This applies to both information and product safety. In this regard, the certification body only checks the package of documents that the applicant provides to him, as well as the correctness of filling out the form. In addition, a declaration can be executed both on the basis of evidence presented by the applicant himself and by a third party. The participation of other organizations depends on what products are manufactured.

Some features

The validity of the certificate or declaration lasts up to five years. But under Russian law, the deadline is only three years.

A manufacturer company that is not a resident of one of the countries of the Customs Union is entitled to draw up the relevant documents. In order to obtain them, the seller, importer or manufacturer confirm compliance with the specified standards, which are included in the Technical Regulations.

Gradual introduction

Each TR of the Customs Union first starts functioning from a transitional period when it is possible to produce goods by presenting a previously issued Certificate of Conformity of the TR of the Russian Federation, or according to a new model. At the same time, exact terms are given during which manufacturers and sellers must adapt to the new rules.

So, to receive this document, fill out a special form, which indicates the manufacturer and the applicant himself. Consider how certificates of conformity are filled out.

In the paragraph "products" indicate the name, type and other information about the product. This type, model, brand, grade, and more. Then they write whether the product is single, a batch or a document is drawn up for mass production. The item “Code OK 005” consists of six digits, and the “” - is filled out only when the products are to be delivered by state order. Not every certificate also fills in the paragraph “HS Code of Russia”. This is relevant only for imported goods.

Next, indicate the full name and list of all protocols completed as a result of research, measurement or testing. The applied certification schemes are also reported immediately.

At the end, fill in the "Details" field, which lists all the documents submitted by the applicant to the certification authority. The forms must be marked with the signature of the expert and the head of the certification body.

Each document is entered in the Register of Certificates of Compliance with the Technical Regulations.

The declaration is made on the basis of the documents submitted by the applicant, but the registration itself is carried out only by the body that is authorized to carry out such actions, that is, it has accreditation.

Schemes

Each TP has its own conformity confirmation scheme . They are selected taking into account the degree of danger of the product, the sensitivity of the specified indicators, the adequacy of the evidence base and the status of the applicant. Consider in which cases one or another scheme is used.

  • 1-5, as well as 8-12 are used in the production, if the applicant is the manufacturer or the person who performs his functions.
  • 6 and 7 apply when receiving a document for a separate batch or unit of goods, if the applicant is the manufacturer, his authorized representative or seller.
  • 1 and 2 are used for such products that are insensitive to changing circumstances of production. In another case, it is better to use the schemes numbered 3, 4 and 5.
  • 4 and 5 are also used for one-time operations. And the choice between them depends on the degree of sensitivity of the products and the importance of this factor to ensure safety.
  • 5 is considered a more serious scheme, but it is not universal.
  • 6 and 7 apply to products purchased abroad if there are no certificates of conformity for the products. They can, for example, be used with one-time delivery.
  • 8, 9, 10 are suitable when it is impossible or difficult to check the finished product. They will also be required if there is a great potential danger in the goods.
  • 11 and 12 will be required for innovative technologies and sophisticated products.
