Workwear Standards

According to the Labor Code of our country, more precisely, article 219, each employee can count on ensuring the protection of his labor, including the provision of PPE for use (the abbreviation of the phrase "personal protective equipment"), as well as collective protective equipment. The issuance of work clothing should come from the employer's funds. The Government of the Russian Federation has determined the procedure for establishing standard norms for the issuance of workwear, personal protective equipment and collective protection, flushing or neutralizing agents, and also special shoes for those workers who are involved in hazardous and hazardous industries. This applies to temperature conditions, noise, vibration, pollution and other harmful factors.

If earlier there was such a thing as β€œindustry standards for the issuance of workwear”, now article 221 of the Labor Code provides for the possibility for the employer to develop improved (compared to the Standard) Standards for the free issuance of workwear and other personal protective equipment within its organization, taking into account its capabilities, including financial and logistic. At the same time, they should be considered and agreed upon by the primary elected body of the trade union organization, whose opinion is taken into account without fail. The purpose of the development of such a document is to improve the protection of workers and reduce the risks of injuries or other accidents during work.

In order for the procedure according to which the organization develops standards for the issuance of overalls, comply with regulatory requirements, and the document itself is timely reviewed and updated depending on changes in the external environment, that is, taking into account the latest requirements of regulatory legal and legislative acts, the organization must develop special instruction. It is advisable to include the following sections:

  • general provisions containing information on those norms and rules that formed the basis of the instruction;
  • the procedure for developing standards in the organization;
  • issuing procedure;
  • storage and care, as well as the procedure for use;
  • purification from contamination, repairs, washing and dry cleaning;
  • responsibility and organization of control.

Standards for the issuance of work clothes are developed for each position and profession taking into account standard norms (the list of items is not less, the frequency is not less, the quality is not worse!), Working conditions and the nature of the work performed. The Norms indicate the type and other characteristics of dressing gowns, insulated jackets, slippers, boots, ankle boots, overalls, protective suits, boots, helmets, gloves, mittens, protective shields and glasses, and so on. Each item has a sock period. The employer must comply with the frequency and other requirements of the Standards, as evidenced by the entries in the personal card for recording the issuance of PPE. Also, from the funds of the employer, storage, repair, washing, drying and replacement are organized.

All employees of the organization are required to comply with the standards for the issuance of workwear. That is, the employee must use it carefully, avoid loss or damage, be sure to meet the allotted time for socks. It can be reduced only in certain cases established by the section of the instruction on the procedure for using workwear, as well as other protective equipment and special shoes. As a rule, such requirements regarding the duties of an employee with respect to the careful and careful use of work clothing are provided for in an employment contract that is concluded upon employment. Therefore, in case of loss or intentional damage to the perpetrator, a certain amount of money may be recovered.

The standards for the issuance of work clothing in an organization should be reviewed annually, as well as updated in a timely manner when changing the structure, staffing or changes in the technological process, which entail new conditions for the performance of work and a change in job responsibilities or nature of work. They can also be reviewed after certification of workplaces or issuance of recommendations by supervisory authorities.
