Many executives require employees to get a work sheet when they are fired. which is a special document indicating personal data (full name, full name of the organization and department) with which the employee must go around several instances of the employing organization before leaving it. This document, often referred to informally as the “slider,” is a guarantee that this employee does not have any material debts to his organization. If such debts are identified, the employee will be obliged to fully repay them before leaving his place of work.
In fact, a workaround upon dismissal (the form of which can be obtained directly from your manager or employee of the personnel department) cannot be required. The execution of this document is not provided for by the Labor Code of the Russian Federation, which means that its requirement can be considered illegal. However, in practice, a retiring employee is much easier and faster to go around all the appropriate authorities necessary to fill out this document than to go into the details of the country's labor legislation and enter into disputes with the organization’s leadership about this. The tacit labor system of our country is such that until the retiring employee submits to his supervisor (or to the human resources department) a completely filled out work sheet, he will not be able to get his work book, as well as a full monetary calculation. In this case, the dismissal procedure begins to be significantly delayed, which is a violation of the requirements of Article 84.1 of the Labor Code of the Russian Federation.
The situation is different with those employees who do not leave the organization of their own free will. They quite have the right to refuse to fill in the “runner”. Violation of their rights established by the labor legislation of the country, they can also appeal in court.
So, the bypass sheet is not provided for by the labor law, and there is no single form for filling it out either. Each organization itself establishes the rules in accordance with which a bypass sheet should be filled out upon dismissal, and a sample is then issued directly to the dismissed employee. It should also be noted that not all employers require this document.
The labor legislation of our country clearly spells out the rules for dismissing employees from their place of work. According to the provisions of the Labor Code, the dismissal of an employee is carried out only by order of his employer. In this case, the employee must familiarize himself with this document in a strictly mandatory manner for signature. If this is not possible for any reason, or the employee refuses to read the order, an appropriate note is made in it. A copy of this document should be handed over to the employee upon his first request.
The issuance of the work book, as well as all documents related to labor activity and the full calculation of the former employee should take place on the last day of his work in this organization, regardless of whether he had filled out a bypass sheet. If for some reason the employee is absent on the last day at work, the employer must send him a notice about the need to get a work book.
The design of the “runner” is practiced in most commercial organizations in Russia. Its existence has its advantages. For example, only with the help of a bypass sheet can an employer force an employee to return pre-trial property that does not belong to him and prevent the theft of organization funds. As you know, dishonest people are found both among employers and among their employees.
