The certificate of origin is a document that proves that the goods were produced in the territory of a certain country and issued by an authorized body. Moreover, if the criteria for issuing this document are different from those that are applied in Russia, the criteria used here must be applied to implement it.

It happens that the document is executed improperly:

  • there are cleanings on it;
  • corrections that are not authenticated properly;
  • lacks stamps and signatures, information allowing to establish the relation to specific goods;
  • the country is ambiguous;
  • it was found that the information in it is false;
  • other discrepancies.

In such cases, the customs authority has the right to apply to the necessary authorities of the country where the certificate of origin was issued in order to find out the missing information. He also has the right to carry out spot checks with the assistance of authorized bodies of the country where he was produced. But its implementation does not prevent the release of goods. After all, they are made on the basis of a document issued in their state. The certificate is submitted together with other documents that are drawn up at customs, including the declaration.

Form A

If countries use the preference scheme, then authorization paper is issued from them with form “A”. If they are parties to the Agreement on the establishment of a free trade zone , then the certificate of form ST-1 confirms the origin of the goods.

In the first case, the customs authorities provide tariff preferences, but only if, according to the Rules, the corresponding columns of the certificates are filled. Otherwise, use:

  • Prior to the verification results, the most favored nation (MFN) regime;
  • before receiving the check, the customs duty rates are doubled;
  • the preference regime begins to apply if the certificate of origin of goods in the proper form is received.

Requirements for filling out a certificate of form “A”

This form is used if goods from Europe or other countries are imported into the territory of developed European countries. The form has a degree of protection in the form of a grid or color field. Notes are written on the back of the document in any language. But they may be absent. It is filled on a typewriter or computer. Blots and cleanings are unacceptable.

The latter is a statement made by the manufacturer, seller or carrier itself. It is provided on the invoice or other document related to the product. A separate document is needed for each batch when delivery is from one sender to one recipient.

If there is an export of goods from a country that is a party to the Agreement, then the issuance of CT-1 certificates is carried out on the basis of the internal law in force in it. Form A4 must have a degree of protection and is made using the printing method. It is valid for a year starting from the day it was received.

Within the CIS, there is a new form ST-1, where there are 13 columns, including the “Criteria of origin”. These documents are also accepted by the customs authority for goods released in one of the CIS countries.

How to fill in the certificate ST-1?

Clause 1 must contain the name and address of the sender. Information can be deducted from the certificate of registration of a legal entity. It may be that the sender is one person and the exporter is another. Then this information should be reflected with the names and addresses of both.

Clause 2 contains information about the name and address of the recipient. At the same time, he may be one person, and the importer - another. Then it is indicated in the column with the names and addresses of both.

Clause 3 describes the route and the vehicle.

Paragraph 4 shall indicate the number of the permit document, its form and the countries, one of which issued it and the other for which it is required.

Point 5 is for service marks. Here the regulatory authorities enter information. For example, if you want to note that the document is a duplicate and issued in return for the certificate.

In paragraph 7 - its quantity and nature of the package.

In paragraph 8, the goods are described. It gives its commercial name and all the data on the basis of which it can be identified. If there is not enough space on the front side, then use an additional sheet, filled out in the manner prescribed by the Rules. The back of the document is not filled out.

Paragraph 9 is called the “Criterion of Origin”. The following designations are adopted here: “P” means production in the territory of a country that is a party to the Agreement; “D” is a product that is processed or processed, then you need to specify the code of the final product according to the HS of the CIS countries (four digits).

Paragraph 10 contains information on the weight in kilograms of gross - net. Moreover, in addition to weight indicators, the quantity of goods may be indicated.

Clause 11 contains the date and number of the invoice with other information about this document.

In case of filling in by an individual, the certificate of origin of goods has its own characteristics. Form ST-1 remains the same. But some points are left untouched.

  1. In paragraph 1, fill out the address of the shipper and his name.

  3. Paragraph 5 and paragraph 11 may remain empty if there is no information.
  4. In paragraph 13, the shipper signs the document and indicates the date.

If the document is damaged or lost, a duplicate is issued. Then, as indicated above, in paragraph 12, the date is stamped when it is issued, and in paragraph 5 they write “Duplicate”. Sometimes a permit is issued after the shipment of the goods. The basis is a written statement by the customer. Then in paragraph 5 the mark “Issued subsequently” is affixed.

If the previous certificate was revoked, then in paragraph 5 they write: “Issued in exchange for the certificate” indicating the date of the previous one. When using the cumulative principle, they write "Cumulation of the CIS" and put down the numbers of those documents and the countries where they were issued.

Three copies of the certificate are issued, of which only one is the original. It should not have any erasures. And if corrections are made, then first erroneous information is crossed out, then reliable information is entered and signed, and also certified by a seal.
