111 articles of the Criminal Code of the Russian Federation (amendments)

Article 111 of the Criminal Code of the Russian Federation provides for punishment for persons who intentionally caused serious damage to the health of one or more citizens. The infliction of such harm entails irreversible consequences for the victims. Let us further consider the features of the corpus delicti and punishment, which are established by Article 111 of the Criminal Code of the Russian Federation. Changes to this rule will also be described in the article.

The main composition of the act

Article 111 of the Criminal Codec of the Russian Federation, under the consequences that arose as a result of grievous bodily harm to the victim, considers:

  1. Loss of vision, ability to talk, hearing, or any organ.
  2. Abortion.
  3. Loss of body functions.
  4. Mental disorder.
  5. Disability no less than 30%.
  6. Permanent disfigurement of the front of the head.
  7. Substance Abuse / Addiction.
  8. Complete loss of ability to carry out labor activity.

This is the main corpus delicti, which provides for 111 articles of the Criminal Code of the Russian Federation. The term of imprisonment for these acts is up to 8 years.

Qualifying signs

Acts that entail the above consequences may be committed in relation to:

  1. A person or his relatives in connection with the performance of his official duties or public debt.
  2. A minor or other citizen who is obviously in a state of helplessness for the guilty, as well as with bullying, special cruelty and torment for the victim.

Article 111 of the Criminal Code of the Russian Federation in part 2 establishes punishment if the crime is committed:

  1. For hire.
  2. Socially dangerous method.
  3. From hooligan motives.
  4. For subsequent use of tissues / organs of the affected person.
  5. Based on religious, national, racial, ideological, political hatred / enmity, as well as directed against any social group.
  6. With the use of weapons or special means.

For such acts, Article 111 of the Criminal Code of the Russian Federation establishes a punishment of up to 10 years in prison. Moreover, a restriction of freedom of up to 2 years may be additionally assigned.

Aggravating circumstances

The above acts may be committed:

  1. A group of persons (organized as well) or by prior agreement.
  2. In relation to two or more citizens.

In the previous edition, Article 111 of the Criminal Code of the Russian Federation contained another aggravating circumstance. Currently, it has lost its power. For these acts is assigned to 12 years in prison. As in the previous case, up to two years of restriction of freedom may additionally be provided.

Death of the victim

This consequence also provides for Article 111 of the Criminal Code of the Russian Federation. Clause 4 establishes a punishment for inflicting grievous injuries on a citizenโ€™s health, resulting in his death due to the negligence of the guilty person. For such an act, imprisonment of up to 15 years is provided. Additionally, a restriction of liberty of up to two years may be imposed.

Acts related to the intentional infliction of grievous bodily harm are considered the most dangerous crimes in the modern world. A high danger to society lies in the behavior of the guilty person, the irreversible consequences that arise for the victim, as well as in a fairly high prevalence. When committing this crime, a person encroaches on the most valuable that a person has - his health. Moreover, the damage caused by his actions is irreparable. So, victims lose their ability to work, become disabled, are deprived of the opportunity to pursue a professional career. Often this subsequently leads to the imminent death of individuals.

Difficulty in applying

The definition of "health damage" is currently considered one of the controversial. This is due to the fact that the criminal law does not mention any of its possible forms. However, in practice, questions often arise regarding the application of the article. Not in all cases the court correctly delimits the acts in question from other criminal assaults.

Objective part

It consists in the unlawful infliction of grievous bodily harm to the health of the victim. The objective side is formed by:

  1. Socially dangerous behavior involving inaction or action.
  2. The resultant consequence in the form of grave damage to health.
  3. A causal relationship between behavior and the subsequent state of the victim.

The actions of the guilty subject can be expressed in chemical, psychological, physical and other effects on another person. Serious injuries to the victim may occur as a result of the inaction of the offender. This means that the perpetrator could and should have committed actions that would have prevented the harm that has come, but did nothing.

Subjective part

It is characterized by the presence of intentional guilt. With direct intent, the culprit understands that his behavior is dangerous to another subject. He assumes and foresees the inevitability or the possibility of damage to health and consciously wishes or allows it. With indirect intent, the perpetrator is indifferent to the consequences for the victim. The actions of the subject during the qualification of the crime are evaluated on the fact of the consequences.

Special composition

Article 111 establishes punishment for the careless death of a victim as a result of severe injuries. In practice, quite often difficulties arise when delimiting this composition from premeditated murder. In such cases, differentiation is carried out on the subjective side. When qualifying an act under Art. 111 intent is aimed at causing harm to health. This means that the guilty did not want the death of the victim. Thus, the death of the latter was the result of the actions originally conceived by him. In a premeditated murder, the subject wishes precisely the death of the victim. In other words, he is attempting on his life, not his health.
