Popular video hosting today has become almost the main content provider. On them contemporaries will learn the latest news, get acquainted with detailed analyzes of the political and social situation in the country, watch entertainment programs. And in almost every video, an obligatory element is a disclaimer that is gradually entering the domestic slang. What does the concept mean, where it came from and in what cases is it applicable? Differences in legal systems are often striking.

The original English term is disclaimer, which is translated in three ways:

  • waiver of the right, renunciation, rejection of claims;
  • disclaimer recorded on paper;
  • accident clause.

Consists of two parts foreign disclaimer. This is the verb to claim, which hides the unpleasant meaning of “make a claim”, as well as from the prefix dis-, formulating a denial. In Russian, a direct recording of transcription with an emphasis on the first "e" appeared.

In the post-Soviet space, the reason for the appearance of such a text is not always obvious. Fashion came from the United States, with foreign resources. You need to understand what a disclaimer is for ordinary viewers:

  • small announcement;
  • a warning.

The author opens the veil of secrecy over the features of the video and recommends refusing to watch it if the person belongs to the “risk group”. So, scenes of violence are not suitable for children, and naturalistic content is even capable of causing irreparable harm to the psyche of an adult.

But there is a nuance: in the Anglo-Saxon system, a mandatory disclaimer is an effective way to remove oneself from administrative or criminal liability. Did someone recognize themselves as a sketch character? But all matches are random, so no deductions for the right to use. Amusement park visitor hurt? The administration cannot reimburse the cost of treatment for those who violated the safety rules, there is an indication on the ticket about this.

Why then do Russian-speaking bloggers turn a text box into an independent joke? Most European countries, including Russia, use German-Roman law. According to it, it does not matter: is it a disclaimer or a humorous inscription - people are obliged to follow the law, and not create and justify the possibilities for violating it.

For an example, contact any wardrobe where they require leaving things, but do not want to compensate for anything in case of theft. And they poke in a piece of paper with the corresponding statement. This is illegal, a citizen has the right to leave the coat with him or to recover the amount stolen from the institution in court.
